Commercial Offences

Defence of companies and directors in commercial offence proceedings, from inspection to judgment.

Legal documentation in proceedings concerning a commercial offence.

Commercial offence proceedings hit both the company and its director: in money, and in reputation with partners. I therefore start the defence as early as possible, often during the inspection itself.

I represent companies and responsible persons before the commercial court and advise on how to keep similar failings from recurring.

What it covers

  • Defence of legal entities
  • Defence of responsible persons
  • Analysis of business documentation
  • Proceedings before commercial courts
  • Tax-related commercial offences
  • Accounting-related commercial offences
  • Appeals and other legal remedies

How I work

I analyse the inspection report and the charge and check whether the acts truly amount to a commercial offence and who in the company was responsible. In court I align the defence of the company with that of the responsible person.

Worth knowing

The company and its responsible person can both be liable for the same offence. It matters to know from the start who was in charge of the task and to have that on paper.

Orderly internal processes are a defence prepared in advance.
